These Terms of Service ("Terms") govern your church's use of Pastor HQ (the "Service"). The Service is operated by the Pastor HQ legal entity registered in New South Wales, Australia ("Pastor HQ", "we", "us").
By signing up, you agree to these Terms on behalf of your church. If you do not have authority to bind your church to a contract, do not proceed. These Terms are deliberately written in plain language — if anything is unclear, write to privacy@pastorhq.comand we'll explain.
1. The Service
Pastor HQ is a multi-tenant analytics and dashboard platform for churches. We connect to the church management system (ChMS) you authorise — Planning Center Online, ChurchSuite, Elvanto, or another supported provider — sync the data you authorise, and render reports, dashboards, and goal-tracking against it. The Service is provided as-is and as-available; we work hard to keep it up but do not promise zero downtime.
2. Your account and your data
You retain all rights in the data your church puts into the Service. We claim no ownership over your member records, donation history, attendance, group memberships, or any pastoral content. Our role is processor, not controller, for any personal information belonging to your members — see the Data Processing Addendum and Privacy Policy for the full picture.
You are responsible for keeping account credentials confidential, for the actions of any user you invite, and for ensuring you have a lawful basis to share each category of data with us. We may suspend access if we reasonably believe your use threatens the safety, security, or integrity of the Service or another customer's data.
3. Plans, billing, and trials
Pastor HQ offers a 30-day no-card trial when you sign up. After the trial, you may upgrade to a paid plan. Pricing is published at pastorhq.com/pricing; the default sticker is AUD $499 per year for a single church, billed annually in advance. Pricing changes with at least 30 days' notice; price changes never apply mid-term.
Payment is processed by Stripe. By providing payment details, you authorise us (via Stripe) to charge your nominated method for the agreed amount. Annual subscriptions are non-refundable except where required by Australian Consumer Law. Failed payments enter a 14-day grace period; if not resolved, the Service moves to read-only mode and is suspended after 30 days.
Inclusive of GST where applicable for Australian customers. Customers outside Australia are billed in AUD; their bank may apply foreign-exchange fees.
4. AI features
Some Pastor HQ features use third-party AI providers (currently Anthropic). These features are off by default and only activate on data the church has explicitly opted in. We do not train AI models on your data, and we do not authorise our AI providers to do so either. AI features run under provider agreements that include Zero Data Retention controls where available. If you require us to disable AI features on your tenant, email privacy@pastorhq.com and we will flip the flag within one business day.
5. Acceptable use
You agree not to: (a) attempt to access another customer's tenant; (b) reverse engineer, decompile, or attempt to extract source code of the Service; (c) use the Service to send spam or harass any person; (d) upload malware or content that is unlawful in Australia; or (e) resell, rent, or sublicense the Service to a third party without our written consent. Reasonable security research that you report responsibly to security@pastorhq.com is welcome.
6. Confidentiality
Each party will protect the other's confidential information with at least the same degree of care as it uses for its own (and never less than a reasonable standard). Our commitments around your member data are described in detail in the DPA and the Security overview.
7. Warranties and disclaimers
We warrant that the Service will perform substantially in line with the descriptions on our public pages and that we will use reasonable skill and care in providing it. We do not warrant that the Service will be uninterrupted, error-free, or fit for any specific purpose beyond those descriptions. Australian Consumer Law guarantees that cannot be excluded continue to apply.
8. Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, even if advised of the possibility. Each party's total aggregate liability under or in connection with these Terms is capped at the fees paid by you for the Service in the twelve months preceding the event giving rise to the claim. This cap does not limit a party's liability for personal injury, fraud, or any liability that cannot be excluded by law.
9. Indemnity
You agree to indemnify Pastor HQ against third-party claims arising from your church's unlawful use of the Service, your breach of these Terms, or your violation of any third party's rights. We agree to indemnify your church against third-party intellectual property claims targeting the Service itself, subject to your prompt notice and our control of the defence.
10. Term and termination
These Terms continue while you have an active subscription. You may cancel at any time; cancellation takes effect at the end of the current billing period. We may terminate for material breach with 30 days' notice (or immediately if your continued access creates a legal or security risk to other customers). On termination, we delete or return your data within 30 days as set out in the DPA.
11. Changes to these Terms
We'll post material changes here with a new "last updated" date and notify active customers by email at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance. If you do not accept a change, you may terminate with a pro-rata refund.
12. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales for any dispute, except that either party may apply to any court of competent jurisdiction for urgent injunctive relief.
13. General
- Assignment: neither party may assign without the other's consent, except to a successor in a merger or acquisition.
- Notices: written notices go to the registered support address of each party. For Pastor HQ that is privacy@pastorhq.com.
- Entire agreement: these Terms, the DPA, the Privacy Policy, and any order form referenced from them form the entire agreement and supersede prior representations.
- Severability: if any clause is held unenforceable, the rest survives.
- No waiver: failure to enforce a right is not a waiver of that right.
